A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi passed the order while hearing a plea filed by Birender Sangwan. On February 22, 67 candidates, including two senior advocates, were placed under summary suspension for alleged large-scale violations of the Model Code of Conduct and the Election Rules, 2023. The clarification came after the temporary US sanctions waiver expired on May 16. The court said that the right to speedy trial cannot be curtailed only because charges have been invoked under the stringent UAPA. In the Gulfisha Fatima case, which dealt with bail pleas linked to the Delhi riots, while several accused got relief, a two-judge bench comprising justices Aravind Kumar and N V Anjaria on January 5, 2026 refused bail to Khalid and Imam and said they can file fresh bail applications following the examination of protected witnesses after one year. A review petition was also dismissed on April 16, 2026. Writing for the bench, Justice Bhuyan noted “serious reservations” about the Gulfisha Fatima ruling. “We have serious reservations on various aspects of the judgment in the Gulfisha Fatima case, including foreclosing the right of the two appellants to seek bail for a period of one year.” The bench even compared the case of Andrabi with the earlier K A Najeeb judgment — which holds an accused cannot be jailed indefinitely — that bars indefinite incarceration as a narrow exception to Section 43D(5), applicable only in extreme facts. Diluting the scope of Najeeb judgment was what troubled the bench on Monday . The Najeeb judgment, which was delivered in 2021 by a three-judge bench of the Supreme Court headed by Justice (later CJI and now retired) N V Ramana, is considered one of the most significant rulings on bail under the UAPA. It held that the bar under Section 43D(5) of UAPA is a limited restriction and must operate within the safeguards of Articles 21 and 22 of the Constitution. “We have no doubt that under UAPA too, bail is the rule and jail the exception” the court noted. Shivraj Raghunath Motegaonkar, who runs Renukai Chemistry Classes (RCC), was arrested on Sunday evening after CBI recovered a leaked question paper of the examination held on May 3 from his mobile phone during searches at his premises, officials said. Motegaonkar was allegedly an “active member of the organised gang” involved in the leakage and circulation of NEET UG 2026 exam. Retired chemistry professor Maharashtra is focal point of NEET probe Motegaonkar’s arrest is the sixth in Maharashtra in the NEET UG paper leak case. Earlier, the CBI had arrested PV Kulkarni, Manisha Mandhare, Subham Kharinar, Dhananjay Lokhande, and Manisha Waghmare for their complicity in the case P V Kulkarni, who was earlier arrested by the CBI for leaking the NEET exam paper, is suspected of having provided the paper to Motegaonkar. Kulkarni was part of the NEET exam paper selection committee. Motegaonkar’s coaching centre has nine branches, includ- ing the main branch in Latur. As part of a conspiracy with other accused, Motegaonkar received the question paper and answers on April 23, nearly 10 days before the examination was held across the country and abroad, the CBI said. The CBI said Motegaonkar provided copies of the leaked question papers and answer sheets to several people in the form of handwritten notes that were destroyed after the examination, for huge sums ranging between `5-10 lakh. Motegaonkar’s son was in Class 12 and a NEET aspirant. For his son’s benefit, Motegaonkar tried to help him, The court has granted nine days’ custody of Motegaonkar to the CBI. P7 EXPRESS NEWS SERVICE @ New Delhi AS the mercury inched towards 45 degrees Celsius on Monday, the IMD has forecast persisting heatwave conditions in the capital this week, from May 19 to May 22. For Tuesday, the IMD has issued a yellow alert for heatwave conditions within the city, and weather experts said the temperature may hit 45 degrees in the next two days. The city recorded a warm Monday morning, with the minimum temperature settling above normal at most weather stations. According to the IMD, Delhi’s base station at Safdarjung logged a maximum temperature of 43.4°C. This was the hottest day in the month of May in two years. “The northwesterly winds are sweeping into the capital from the Thar Desert region of Rajasthan and parts of central Pakistan. Travelling across vast arid stretches, these winds turn intensely dry by the time they reach Delhi, trapping heat close to the surface and sharply intensifying the searing conditions across the city,” said Mahesh Palawat of Skymet Weather. There is no forecast of thunderstorms or pre-monsoon rainfall activity over the next 10 days, he said. Meanwhile, the peak power demand in the capital soared to 7,542 megawatts, the highest so far this summer. This year, the peak power demand in Delhi is estimated to cross 9,000 MW. Singh, who also goes by an alias of Raj Singh, was arrested in Muzaffarnagar in western Uttar Pradesh by a team of CBI officials, they said.
