A bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra set aside the National Company Law Appellate Tribunal (NCLAT) ruling that upheld the transfer of the airline’s ownership to JalanKalrock Consortium (JKC). The bench stated that the liquidation was in the interest of creditors, workers, and other stakeholders of Jet Airways. T he court noted JKC’s failure to infuse the promised funds of `350 crore to revive the cash-strapped airline. The SC said no progress was seen the resolution plan even after five years, leaving it with no choice but to send Jet Airways into liquidation. “Keeping in mind the fact that almost five years have elapsed since the Resolution Plan was duly approved by the NCLAT and there being no progress worth the name, we are left with no other option but to invoke our jurisdiction under Article 142 of the Constitution and direct that the corporate debtor be taken in liquidation,” it said in the order. The SC held the NCLAT’s directive for the SRA to adjust `150 crore towards the first tranche payment was in disregard of the Supreme Court’s earlier order and the terms of the resolution plan. The bench also ordered forfeiture of `200 crore invested by the consortium and authorised the lenders to invoke the `150 crore bank guarantee to recover some of their dues. The NCLAT had in March upheld the resolution plan of Jet Airways and approved the transfer of its ownership to JKC. SBI, Punjab National Bank, and JC Flowers Asset Reconstruction Pvt Ltd challenged the NCLAT verdict. Jet Airways stopped flying in April 2019. The National Company Law Tribunal in June 2021 gave approval to the Kalrock Capital and Murari Lal Jalan consortium’s bid for Jet Airways, eight months after the lenders had given a goahead to its resolution plan. The consortium was supposed to infuse `1,375 crore in Jet Airways over 2-3 years. In the first tranche, it was to infuse `350 crore and `250 crore in the second tranche. The remaining `775 crore was to be infused from the second year. However, the consortium put in only `200 crore. ‘NCLAT order perverse’ The Supreme Court rapped the NCLAT for allowing the Jalan-Kalrock Consortium to take over Jet Airways without fulfilling its payment obligations, terming the Appellate Tribunal’s verdict ‘perverse’ Payment norms flouted SC noted that the NCLAT’s approval of adjusting the performance bank guarantee as a partial payment was in “flagrant disregard” of an earlier directive of the court, as well as the terms of the resolution plan Now, Ayurveda Biology in the UGC-NET Ayurveda Biology has now been introduced as a subject in the UGC-NET exam, the University Grants Commission (UGC) announced on Thursday. However, the cultivators have called the action “counter-productive”. On October 23, the Supreme Court termed the Environment Protection Act (EPA), 1986, and the small fines for stubble burning as “toothless”. Under the new regulations, farmers with less than two acres of land will be required to pay an environmental com- pensation fee of `5,000. For those with over two acres but less than five acres the penalty will be `10,000. Farmers having than more than five acres will face a fine of `30,000 for burning paddy stubble. Previously the fines were lower. Farm, ers holding less than two acres of land were fined `2,500, while it was `5,000 and `15,000 for those with 2-5 acres and over five acres, respectively .
